Ellis & Hart Terms of Service

In these Terms, "we", "us" and "our" mean Ellis & Hart, a trading name of CAPITALION LTD, registered in England and Wales, company no. 17075992, registered address 167-169 Great Portland Street, London, W1W 5PF, United Kingdom. We run this online store and website (the "Services"), which is built on Shopify. By using our Services or placing an order, you agree to these Terms and our Privacy Policy. Nothing in these Terms affects your statutory rights as a consumer.

1. Who Can Buy

You must have reached the age of majority where you live to place an order. Our products are for children, but they are sold to adults. Your account is personal, and you are responsible for keeping your login details secure.

2. Our Products and Safety

We show our products as accurately as we can, but colours may look slightly different on your screen. Each product page shows the recommended age range and any safety warnings; please read them and supervise young children during play. We may limit quantities or stop offering a product at any time.

3. Orders

When you place an order, you make an offer to buy the products in it. A contract is formed when we confirm your order by email. We may refuse an order, for example if a product is unavailable or a payment cannot be verified, in which case we refund any amount taken. Returns and exchanges are handled under our Refund Policy.

4. Prices and Payment

Prices are shown in the currency of your country (GBP in the United Kingdom, AUD in Australia, EUR in Germany) and include VAT or GST where applicable. Delivery charges are shown at checkout before you pay, as set out in our Shipping Policy. You pay the price shown when you placed your order.

5. Delivery

We deliver to the United Kingdom, Australia and Germany only. Delivery times in our Shipping Policy are estimates. Risk of loss passes to you once your order has been delivered to you or to a person you nominate.

6. Your Consumer Rights

Our products must be as described, of satisfactory quality and fit for purpose. In the United Kingdom, this is set out in the Consumer Rights Act 2015. In Australia, our goods come with guarantees that cannot be excluded under the Australian Consumer Law. In Germany, you have the statutory warranty rights under German law and a 14-day right of withdrawal, described in our Refund Policy.

7. Intellectual Property

All content on our Services belongs to Ellis & Hart or its licensors and is protected by intellectual property laws. You may not copy or reuse it without our written permission.

8. Third-Party Links and Tools

Our Services may contain links to third-party websites or optional third-party tools. We do not control them and are not responsible for their content or practices.

9. Relationship with Shopify

Our store is powered by Shopify, but every purchase is made with Ellis & Hart directly. Shopify has no responsibility for transactions between you and us.

10. Errors

If our Services contain an error, for example in a price or description, we may correct it. If your order was placed on incorrect information, we will contact you before changing or cancelling it and refund any amount taken.

11. Prohibited Uses

You may use our Services only for lawful purposes and must not misuse them, for example by spreading harmful code, scraping personal data or infringing anyone's rights.

12. Limitation of Liability

To the extent the law allows, we are not liable for indirect or consequential losses. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything that cannot be limited by law, and nothing excludes the consumer guarantees you have under the law of your country.

13. Governing Law

These Terms are governed by the laws of England and Wales. If you are a consumer living in Australia or Germany, you also keep the protection of the mandatory consumer laws of your country and may bring proceedings in your local courts.

14. Online Dispute Resolution

We are not obliged and not willing to take part in dispute resolution proceedings before a consumer arbitration board. Please contact us first: we will always try to resolve any issue directly.

15. Changes to These Terms

We may update these Terms at any time. The Terms in force when you placed your order apply to that order.
